A proposed class-action lawsuit has been filed in Quebec against National Bank of Canada on behalf of mortgage borrowers on whom the bank charged certain fees.
Specifically, Montreal-based law firms Paquette Gadler Inc. and Adams Avocat Inc. announced on Friday that they have filed a proposed class action against National Bank on behalf of mortgagees who have been required to pay professional fees to the bank “in connection with the recovery of the capital or the interest secured by the mortgage or to preserve the charged property.”
For example, the law firms say that borrowers who have been required to pay legal fees as a result of a default may be covered in the proposed suit.
The allegations have not been proven and the lawsuit has yet to be certified as a class action.
