A hearing panel of the Investment Dealers Association of Canada has dismissed charges against Tiffany Yen Siam Mu, formerly registered as an investment representative with the Vancouver office of RBC Dominion Securities Inc.
IDA staff brought two charges against Mu alleging that in October 2003 she submitted to the IDA a Registration Transfer Information application and a National Registration Database (NRD) registration form that were false or misleading. In addition, staff alleged that in September 2004, Mu submitted to the IDA a NRD registration application that was false or misleading.
The allegations arose as a result of Mu’s responses to certain questions on registration application forms in respect of employment with two IDA Member firms in October 2003 and September 2004 respectively.
The hearing panel found that although Mu’s responses to certain questions were technically false, she did not know how to properly answer the questions. Further, the panel found that she believed that her answers were accurate and subsequent to completing the forms she attempted to determine whether she had taken the proper course of action. The panel also found that Mu had relied on a letter she received from the IDA regarding the termination of her employment from DS.
Mu is no longer employed in the industry.
