The Ontario Court of Justice found Barry Landen, a former senior officer at Agnico-Eagle Mines Ltd., guilty of insider trading on Friday.
The Ontario Securities Commission had laid insider trading and tipping charges against Landen in November 2005.
The OSC alleged that Landen, former vice-president of corporate affairs, sold securities of Agnico-Eagle Mines on Oct. 10 and Oct. 24, 2003, while in possession of undisclosed information.
In addition, the OSC had alleged that Landen tipped acquaintance Stephen Diamond about an undisclosed material fact about Agnico in September and October 2003.
Landen was found guilty of insider trading, but not guilty of tipping Diamond, by Justice Shamai of the Ontario Court of Justice.
Diamond was found not guilty of insider trading.
