The Saskatchewan Financial Services Commission has issued a staff notice detailing how privacy legislation applies to records provided under securities law.
The notice sets out how the provisions of The Freedom of Information and Protection of Privacy Act and the Securities Act relate to access to records created, collected or filed under the Securities Act. Privacy legislation provides that every person has a right of access to records that are in the possession of a government institution, subject to certain exemptions.
Securities legislation provides that most filings with the commission are made public, but that the commission can keep private information contained in internal reports and records of the commission; and that no one shall disclose, except to their counsel, any information provided as part of an investigation.
The notice includes an inventory of the records that are created, collected or filed under the Securities Act; whether the record is considered to contain personal information; whether the record contains confidential information; and whether it can be made available to the public.
