Two Calgary-based mining firms are suing TSX Group Inc. in a challenge of a stock trading halt and other decisions made by the stock market company’s junior TSX Venture Exchange.
Flag Resources Ltd. and Golden Briar Mines Ltd. said today their lawsuit disputes the trading ban and a request by the TSX-V that businessmen Murdo Mcleod and Sidney Miszczuk resign their posts as directors of Flag.
The decisions were made based on the exchange’s authority under listing agreements.
The lawsuit was begun in the Court of Queen’s Bench of Alberta, the companies said.
“he lawsuit raises important issues about the extent to which the TSX-V can control the internal functioning of listed issuers and the manner in which the TSX-V conducts it investigations and makes its decisions,” Flag and Golden Brian said in a joint statement. “The lawsuit also challenges the factual basis on which the decisions were made.”
The TSX Venture Exchange imposed trading bans on both companies last June 25.
